“In terms of complexity, the mental capacity required and the analysis skills needed, applying for NHS Continuing Healthcare (NHS CHC) funding was as complex as some of the nuclear deterrent policy I worked on.” So said Philip Mathias, a retired rear admiral of the royal navy, in a major Daily Telegraph article published last week.
Mr Matthias said he faced the “fight of his life” to get the NHS to pay CHC funding for his late mother, who suffered from severe dementia. It’s a story similar to those we hear every day at Just Caring Legal.

Mr Matthias eventually won. His two-year battle with Wiltshire Clinical Commissioning Group (CCG) required over one hundred letters and emails and three meetings. But he eventually recovered £200,000 in care fees that he should never have paid. At the final hour, an Independent Panel agreed Mr Mathias had been right all along. Wiltshire CCG had failed to follow correct procedures. His mother did qualify for the funding. Tragically, she passed away just hours after the CCG agreed to pay up.
Mr Mathias said this two year saga tested him “to the absolute limit”.
“I needed a solicitor”
It’s a sentiment echoed by comments in recent social media posts. One Facebook commenter said: “I have two postgraduate degrees and like Admiral Mathias I have found the analysis skills needed to fight for CHC quite something else.”
Another currently going through an appeal process said she “needed a solicitor as the legal jargon was beyond me”.
